These Terms of Use (“Terms“) govern your use of thrivecreative.ltd (“the Site“), operated by Thrive Creative Ltd. (“Thrive“, “we“, “us“). By accessing or using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.
These Terms cover your use of the Site itself. They do not govern the services we may agree to provide you — those are covered by separate Statements of Work or service agreements that we sign with you per engagement.

Thrive Creative Ltd. is a Canadian software-development and embedded-engineering firm based in Calgary, Alberta. We’re incorporated under Canadian law.

2. Permitted use of the Site
You may browse, link to, and share content from the Site for personal or business research purposes. You may submit contact, lead, or booking forms with genuine inquiries. That’s it — anything more requires our written permission.
3. Prohibited conduct
You agree not to:
- Use the Site to violate any law, infringe any third-party right, or impersonate any person or organization
- Attempt to gain unauthorized access to any part of the Site, our infrastructure, or any account
- Probe, scan, or test the vulnerability of the Site without our prior written permission (responsible disclosures via security@thrivecreative.ltd are welcome — see our /.well-known/security.txt)
- Interfere with the Site’s availability — denial-of-service, intentionally degrading performance, spam, or flooding
- Submit forms with knowingly false information, automated submissions, or content that contains malware, viruses, or other harmful code
- Reverse-engineer, decompile, or extract source code from any part of the Site
- Scrape, harvest, or systematically copy substantial portions of the Site without our prior written permission
- Use any robot, spider, or other automated means to access the Site for any purpose without our prior written permission (search-engine crawlers respecting our
robots.txtare an exception) - Frame, mirror, or republish substantial portions of the Site without our prior written permission
- Use the Site to send unsolicited commercial communications
4. Intellectual property
Everything we’ve published on the Site — written content, design, logos, code, illustrations, photos — is owned by Thrive Creative Ltd. (or our licensors) and protected by Canadian and international copyright, trademark, and other intellectual-property laws.
You may:
- View the Site as intended in a browser
- Quote short excerpts of our written content with attribution and a link back to the source page
- Share links to our pages
You may not:
- Copy substantial portions of our content for republication
- Use our trademarks (including “Thrive Creative” and our logo) without our written permission
- Use Site content to train machine-learning models without our written permission
5. Content you submit
When you submit content to the Site (form messages, file attachments, questions in our chat tool if we add one, etc.):
- You confirm you have the right to share that content
- You grant us a perpetual, royalty-free, worldwide licence to use that content for the purpose of responding to your inquiry and (if applicable) delivering the services you’ve asked about
- You take responsibility for the content’s accuracy and legality
Personal information you submit is handled per our Privacy Policy.
6. Third-party links
The Site may link to third-party websites (e.g., our LinkedIn profile, grant program pages, our software partners). We don’t control those sites and aren’t responsible for their content, accuracy, or practices. Following a link is at your own discretion.
7. Disclaimers
The Site is provided “as is” and “as available.” We make no warranties — express or implied — about its accuracy, completeness, suitability for any purpose, availability, or non-infringement.
Specifically, we don’t warrant that:
- The Site will be uninterrupted or error-free
- Defects will be corrected
- The Site or the servers serving it are free of viruses or other harmful components
- Any information on the Site is current, accurate, or applicable to your particular situation
If you act on something you read on the Site without verifying it with us first, that’s on you.
8. Limitation of liability
To the maximum extent permitted by Canadian law, Thrive Creative Ltd., its directors, employees, contractors, and affiliates will not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, revenue, data, goodwill, or business opportunity — arising from your use of (or inability to use) the Site, even if we’ve been advised of the possibility of those damages.
Some jurisdictions don’t allow certain limitations of liability — to the extent your jurisdiction is one of those, our liability is limited to the maximum permitted by the law of that jurisdiction.
9. Indemnification
You agree to indemnify and hold Thrive Creative Ltd. harmless from any claim, demand, loss, or damages (including reasonable legal fees) arising from your breach of these Terms, your violation of any law, or your infringement of any third party’s rights through your use of the Site.
10. Termination
We may suspend or terminate your access to the Site (or any part of it) at any time, with or without notice, for any reason — including violation of these Terms.
Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law, contact) survive termination.
11. Governing law and dispute resolution
These Terms are governed by the laws of Alberta, Canada, without regard to its conflict-of-law provisions.
Any dispute arising under or in connection with these Terms will be brought exclusively in the courts of the Province of Alberta, Canada, and you consent to the personal jurisdiction of those courts.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we’ll update the “Last updated” date at the top of this page, and — for material changes — we’ll note the change prominently on the Site for at least 14 days before it takes effect. Continued use of the Site after a change indicates your acceptance of the updated Terms.
13. Severability
If any part of these Terms is found to be invalid or unenforceable by a court, the remaining provisions stay in effect.
14. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Thrive Creative Ltd. regarding your use of the Site.
